Few seem to have noticed that we are actually living in the 21st Century, when the  issues about discrimination law don’t revolve around disparate treatment but around disparate impact.

Firefighter cases seem to provide the best examples of what the current law [about discrimination and affirmative action] is, which isn’t anything like what everybody has been talking about.
