Tataquason said he was “deeply hurt” by the remarks. It caused him to “trigger” memories of residential schools he has tried to bury since childhood. Tataquason testified that he “spiraled into depression,” leaving him unable to work. The remark is also responsible for his return to drug use, his marriage breakup, his homelessness and his committing petty crimes, Tataquason testified.
His then-common law wife, Roseann Durocher, testified it also caused her to return to substance abuse. She testified she “wholly believes” Pontes evicted Tataquason because of his race.

[Restaurant owner] John Pontes refused to appear at the hearing.
In an interview, Pontes said Tataquason “will not get a dime from me.” Pontes said as a Portuguese immigrant with dark skin, he’s been called many racist names and faced “real” discrimination.
“It’s my restaurant and he was adamant about sitting with his wife while she worked. I wanted her to do some work,” Pontes said.
“I am cocky and speak lots, but that doesn’t make me a racist. I am not racist in any way, shape or form.”
According to the ruling, the onus was on Pontes to prove he did not discriminate by denying service to someone in a restaurant.
Pontes was found to have inflicted an injury to Tataquason’s dignity and was ordered to pay $7,000. The maximum for such an offence is $10,000
